GENERAL TERMS AND CONDITIONS OF SALE (GTC) – FASTING AND HIKING RETREATS

1. PURPOSE

These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) are intended to define the contractual terms applicable between La Lune Rose Association (hereinafter referred to as “the Association”) and any individual booking a fasting and hiking retreat (hereinafter referred to as “the Participant”).

These GTC apply to any order or reservation of services (hereinafter referred to as the “Retreats”) made by the Participant with the Association.

2. BOOKING TERMS

A Retreat booking is made by completing the registration form provided by the Association. All bookings are subject to availability of the selected dates and are only considered final upon receipt of the completed registration form and payment of the €180 deposit by bank transfer to the Association.

Once registration is confirmed, the Participant will receive an information and preparation document detailing recommendations prior to the Retreat, including dietary preparation, practical guidelines, potential health precautions, and all information necessary for the smooth running of the stay. The Participant agrees to read this information carefully and, where possible, to follow the recommendations provided.

3. PRICE, CONTENT OF THE SERVICE, AND PAYMENT TERMS

3.1 Content of the service

Unless otherwise specified at the time of booking, the Retreat includes:

  • A 6-night / 7-day stay according to the selected dates;

  • Accommodation at the retreat venue according to the chosen package;

  • Supervised Buchinger-style fasting guidance;

  • Beverages included in the fasting protocol (water, herbal teas, broths, fresh juices);

  • Daily hikes adapted to the group’s level;

  • Access to on-site facilities, including swimming pool, massage chair, and shared common areas, subject to seasonal availability, weather conditions, and on-site usage rules;

  • Scheduled group activities, including yoga classes, workshops, conferences, and other wellness activities offered during the Retreat.

3.2 Services not included

Unless otherwise specified, the following are not included in the price:

  • Transportation to and from the Retreat venue;

  • Additional personal insurance coverage;

  • Optional massages, treatments, or individual services;

  • External medical or paramedical consultations;

  • Any personal expenses.

3.3 Prices

Prices are stated in euros. Applicable prices are those in effect at the time of booking and communicated to the Participant through the website, registration form, or any written communication from the Association.

3.4 Payment terms

A €180 deposit is required at the time of booking and must be paid directly to La Lune Rose Association. This amount covers guidance-related costs, including FFJR membership, insurance, equipment, various retreat supplies (juices, broths, herbal teas), as well as yoga classes, workshops, and group activities included during the stay.

The balance, due 15 days before the beginning of the Retreat, covers accommodation costs and must be paid directly to SARL Le Clos de la Duchesse by bank transfer, cash, or cheque.

In the event of a personal modification to the original program (switching to a juice cleanse or monodiet), a flat-rate supplement of €80 will apply.

4. CANCELLATION AND REFUND POLICY

4.1 Cancellation by the Participant

Any cancellation made more than 30 days before the Retreat start date entitles the Participant to either a postponement or refund. After this deadline, the deposit remains non-refundable and retained by the Association. Any Retreat that has begun is payable in full, regardless of the reason for interruption.

4.2 Cancellation by the Association

In the event of cancellation initiated by the Association, all sums paid will be refunded in full. An alternative solution may be offered where possible.

4.3 Cancellation procedure

Any cancellation request must be submitted in writing (email or postal mail), including the Participant’s contact details and booking reference. The date of receipt of the request shall determine applicable cancellation terms. Participants are encouraged to purchase personal cancellation insurance.

4.4 Early departure or late arrival

In the event of early departure or delayed arrival, regardless of cause, the full cost of the Retreat remains due.

4.5 Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the Participant is informed that the 14-day withdrawal right applicable to distance contracts does not apply to accommodation and leisure services provided on a specific date or according to a determined schedule. Consequently, any booking for a Retreat with fixed dates is firm and final, subject to the cancellation conditions set forth in these GTC.

5. LIABILITY FOR LOSS, THEFT, OR DAMAGE TO PERSONAL BELONGINGS

The Association shall not be held liable for loss, theft, or damage to the Participant’s personal belongings during the Retreat.

6. ARRIVAL AND DEPARTURE CONDITIONS

Arrival is possible from 5:00 PM on the scheduled Retreat start date. Early arrival may be considered subject to availability.

Departure is scheduled for 1:00 PM following the refeeding meal, unless otherwise agreed in advance.

7. PROGRAM MODIFICATIONS

The Association reserves the right to modify scheduled activities in the event of unfavorable weather conditions, safety constraints, force majeure, or any circumstances beyond its control.

Any such modifications will, where possible, be communicated in advance and replaced with an appropriate alternative solution.

8. INTELLECTUAL PROPERTY

All documents, materials, programs, content, and information provided as part of the Retreat remain the exclusive property of the Association.

Any reproduction, distribution, representation, or use, whether partial or total, for commercial or non-commercial purposes, without prior written authorization from the Association, is strictly prohibited.

9. DATA CONFIDENTIALITY

Personal data collected during booking is used solely for administrative, organizational, and internal purposes. Such data is treated confidentially.

No personal data will be shared with third parties without the Participant’s prior consent, except where legally required or necessary for the execution of the Retreat.

10. CONTRAINDICATIONS TO FASTING PRACTICE

Retreats are reserved for adults whose health condition is compatible with a wellness fasting and hiking retreat, including the ability to walk approximately 3 hours per day. Certain contraindications or specific medical situations may require adjustments or exclude participation.

The following conditions notably exclude participation in the fasting program as offered by the Association:

  • Advanced coronary disease;

  • Extreme underweight;

  • Eating disorders (anorexia, bulimia);

  • Advanced cerebral arteriosclerosis;

  • Type 1 diabetes;

  • Retinal detachment;

  • Pregnancy or breastfeeding;

  • Decompensated hyperthyroidism;

  • Liver failure;

  • Kidney failure;

  • Tumoral disease;

  • Certain active or unstable autoimmune diseases;

  • Multiple sclerosis;

  • Stomach or duodenal ulcer.

A medical certificate confirming no contraindication to fasting is required for any Participant undergoing treatment or presenting a specific medical condition.

In case of doubt, the Association may offer a medical consultation, at a fee of €60, with a physician from the Medical Academy of Fasting.

The Association reserves the right to refuse or interrupt participation if a Participant’s health condition, behavior, or declarations appear incompatible with safety, the proper conduct, or the spirit of the Retreat, without entitlement to reimbursement beyond the provisions set forth in these GTC.

11. ACCEPTANCE OF THE GTC

By registering, the Participant:

  • Certifies that participation is voluntary, informed, and undertaken freely;

  • Acknowledges having read and accepted these GTC without reservation;

  • Certifies being capable of walking at least 3 hours per day or having disclosed any limitation;

  • Agrees to assume personal and collective responsibilities during the Retreat;

  • Acknowledges awareness of fasting-related contraindications;

  • Agrees to provide any required medical certificate or documentation in case of treatment or specific condition;

  • Confirms having personal insurance covering civil, private, and bodily liability;

  • Agrees to inform the Association of any change in health status between registration and the start of the Retreat;

  • Certifies that all information provided is truthful, accurate, and complete.

12. NATURE OF THE RETREAT

The Retreats offered by the Association are exclusively part of a wellness, prevention, and healthy lifestyle approach. They do not constitute medical, therapeutic, or paramedical services under any circumstances and do not replace medical advice, diagnosis, or treatment.

The Participant acknowledges full awareness of the non-medical nature of the Retreat and agrees to consult an appropriate healthcare professional in case of doubt.

13. PERSONAL DATA PROTECTION

Personal data collected as part of registration and booking is used exclusively for administrative, organizational, and safety-related purposes connected to the Retreat. Such data is treated confidentially and is neither sold nor transferred to third parties without prior consent, except where legally required or necessary for the execution of the Retreat.

In accordance with applicable regulations, including the General Data Protection Regulation (GDPR), the Participant has the right to access, rectify, delete, or object to the processing of personal data upon written request to the Association.

14. CONSUMER MEDIATION AND DISPUTES

In accordance with Articles L611-1 and following of the French Consumer Code, the Participant may make use of a consumer mediator free of charge for the amicable resolution of any dispute relating to these GTC, after first attempting direct resolution with the Association.

Failing amicable resolution, any dispute shall fall under the jurisdiction of the competent courts in accordance with French law.
